Terms of Service

ExoCort is provided by [to be completed before launch], located at [to be completed before launch] (the "Provider", "we", "us"). You can reach us at [email protected].

These terms form an agreement between you and the Provider. By adding ExoCort to a Discord server, by using it, or by subscribing to a paid plan, you agree to them. If you do not agree, do not use the service.

These terms are written in English. Any translation is provided for convenience only, and the English version governs.

ExoCort is an assistant that runs as an application inside Discord. It answers questions, remembers what you tell it, keeps notes and tasks you create, and can search the web when you ask it to. To produce answers it sends your messages and the material you attach to third party language model providers.

ExoCort is a tool. It is not a person, not an adviser, and not a substitute for professional judgement. See section 8.

You must be at least 16 years old, or the minimum age at which you can consent to the processing of your personal data in your country if that age is higher. You must also comply with Discord's own terms, because ExoCort runs inside Discord and cannot be used without a Discord account.

If you add ExoCort to a server used by other people, you are responsible for telling them that it is there and what it does. Anyone who can write in a channel where ExoCort is present can interact with it, and their messages in that channel are processed in the same way as yours.

ExoCort offers a free plan and paid subscription plans. Current plans and prices are shown on our website and may change; a price change never applies to a subscription period you have already paid for.

Payments are processed by Paddle.com Market Ltd, which acts as the merchant of record and the reseller of our product. This means Paddle, and not the Provider, is your contracting party for the purchase itself, issues your invoice, and is responsible for the collection and remittance of applicable sales taxes. Paddle's own buyer terms apply to the transaction.

Paid plans renew automatically each month until cancelled. You may cancel at any time; cancellation takes effect at the end of the period you have paid for, and you keep access until then. Refunds are covered by our refund policy.

Every plan includes a monthly allowance of assistant work rather than a fixed number of messages. The reason is simple and worth stating plainly: answers cost us real money at the model providers, and a long answer over a large document costs many times more than a short reply. An allowance measured in work is therefore honest, where a message count would not be.

When the allowance for a period runs low, the assistant keeps working but may use smaller models or ask you to wait until the allowance refills. Allowances refill continuously rather than resetting on a fixed day.

We may change allowances. If a change reduces what your plan includes, we will tell you before it takes effect, and you may cancel and request a refund for the unused part of the current period.

You agree not to:

• use ExoCort for anything unlawful, or to produce content that is unlawful;
• use it to harass, deceive or harm other people, or to generate material that sexually exploits minors, incites violence, or facilitates serious crime;
• attempt to reach data belonging to another server, another space or another person, or to circumvent the separation between them;
• resell, sublicense or provide ExoCort to third parties as your own service;
• automate access in a way that is designed to exceed your plan allowance, or otherwise place a disproportionate load on the service;
• attempt to extract our prompts, model configuration or source code, or to interfere with the operation of the service.

If you breach this section we may suspend or terminate your access. Where the breach is not serious and can be fixed, we will contact you first.

Everything you write to ExoCort, and everything it stores on your behalf, remains yours. You grant us only the permission we need in order to run the service: to store your content, to process it, and to send it to the model providers and other services listed in our privacy policy so that an answer can be produced.

You are responsible for the content you give to ExoCort. Do not give it material you have no right to share, and please consider carefully before giving it special categories of personal data such as health or biometric information.

ExoCort generates text using language models. Such models are probabilistic: they can be confidently wrong, can misread a document, and can invent details that look plausible. This is a property of the technology, not a defect we expect to remove.

You must not rely on its output as legal, medical, financial, tax or other professional advice, and you should check anything that matters against a primary source before acting on it. Decisions you take on the basis of its output are yours.

ExoCort depends on services we do not control, in particular Discord, the model providers reached through OpenRouter, and, when you ask for a web search, a search provider. If one of them is unavailable or changes its terms, parts of ExoCort may stop working. We are not responsible for those services, and their terms apply to your use of them.

We do not promise that ExoCort will be available without interruption. It is operated by a small team, it is early in its life, and it is offered as it is. Maintenance, failures at a provider, and faults in our own software will all cause downtime at times.

We may add, change or remove features. Where a change materially reduces what a paid plan offers, we will give you notice and the option described in section 5.

You may stop using ExoCort at any time by cancelling your subscription and removing the application from your server.

When ExoCort is removed from a Discord server, the data belonging to that server is deleted, as described in the privacy policy. This is not reversible. If you want to keep anything, take a copy before you remove the application.

We may terminate or suspend your access if you breach these terms, if we are required to by law, or if we discontinue the service. If we discontinue the service, we will give reasonable notice and refund the unused part of any period you have paid for.

ExoCort is provided as it is and as available, without warranties of any kind so far as the law permits. We do not warrant that its output will be accurate, complete or fit for any particular purpose.

To the extent permitted by law, our total liability to you arising out of or in connection with the service is limited to the amount you paid for it in the twelve months before the event giving rise to the claim. We are not liable for indirect or consequential loss, for lost profits, or for loss of data to the extent that you could reasonably have kept your own copy.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are not affected by anything in these terms.

We may update these terms. If a change is material, we will give notice through the service or by email before it takes effect. Continuing to use ExoCort after a change takes effect means you accept the updated terms. If you do not accept them, you may cancel, and we will refund the unused part of the current period.

These terms are governed by the law of Ukraine. If you are a consumer, you also keep the protection of the mandatory rules of the country in which you live, and you may bring proceedings there.
